Acceptance of Terms and Conditions
Your access to the Platform or its associated mobile application, or the creation of an account thereon, constitutes your express and unconditional acceptance of all rules, terms, conditions, warranties, and guidelines set forth in this document, including the terms governing use, payment, and financial transactions.
These Terms and Conditions are legally binding upon acceptance; therefore, please read them carefully before using the Platform.
These Terms and Conditions apply to all users and visitors of the Platform without exception.
Nature of the Platform and Scope of Operations
The Platform is an electronic technology infrastructure that enables its users to create online stores for the purpose of conducting e-commerce and managing orders. The services provided by the Platform include, without limitation: the creation and design of online stores, product and inventory management, order processing and tracking, provision of analytics and reporting tools, facilitation of shipping and delivery operations, and management of communications with buyers.
The Platform operates solely as a technology service provider, and its responsibility is limited to providing the digital infrastructure necessary to enable users to conduct their commercial activities. Accordingly:
- a) The Administration does not own, sell, trade in, or exercise control over the quality or pricing of any products or services listed on the stores created by users.
- b) The Platform shall not be deemed a party to any contract of sale or commercial transaction conducted between the user (merchant) and the buyer, and full responsibility for such transactions shall rest exclusively with the parties thereto.
- c) The Platform bears no liability with respect to the conformity of listed products or services to their advertised specifications, their fitness for purpose or safety, or any damage that may arise from their use.
- d) The user (merchant) alone bears full responsibility for compliance with all applicable laws and regulations pertaining to the products and services they offer, including consumer protection laws, safety standards, and import and export requirements.
The Platform is available for operation in the Republic of Tunisia, the Middle East region, and worldwide, with the aim of facilitating access to investment opportunities in the field of e-commerce.
Fees and Commissions
Upon creating an account on the Platform and using its services, the user shall be provided with their own online store. The Platform shall not charge any fees until the user's total sales reach ten thousand (10,000) Tunisian Dinars or the equivalent in US Dollars at the prevailing exchange rate at the time such threshold is reached.
After exceeding the threshold of ten thousand (10,000) Tunisian Dinars or the equivalent in US Dollars in sales, the Platform shall charge a commission of three per mille (0.3%), equivalent to three (3) Dinars for every one thousand (1,000) Dinars in sales.
A user whose total sales over the preceding thirty (30) days exceed ninety thousand (90,000) Tunisian Dinars or the equivalent in their online store's currency shall be eligible to benefit from fixed monthly subscription plans. This option shall be activated automatically upon reaching said threshold, and subscriptions start from ninety-nine (99) US Dollars per month, tiered according to the monthly transaction volume ceiling of the online store. The user retains full discretion to choose one of the fixed monthly subscription plans or to remain on the three per mille (0.3%) commission model.
Service usage prices are subject to modification. In the event of any change, the Administration undertakes to notify users thirty (30) days prior to the effective date of such modification via their registered email address.
